Would this not make the potential "win" much more profitable since there would be multiple defendants? Some of these "other than Vivitar" might actually be making a nickel or two with far deeper pockets than Vivitar.
If this line of speculation is true, then this could have been the ultimate strategy from the beginning -- hook the little fish as bait for the larger fish (major chip maker, manufacturer, ODM)?
I like the idea of Nunnley being the point person for EDIG. His incentive needs a clear win to collect -- not just a paid consultant. He also has incentive to move DM along to the best of his ability. Obviously, DM will move at their pace, but having someone on the home team interacting with DM on a regular or semi-regular basis is a big plus, IMO. From my experience, nothing in the legal world moves swiftly, unless you are on the wrong end of the gun. Vivitar and their joined band of mean ole copy cats would very much like this case to drag out.
Of course, there are those darn light bills and payroll and lunches at Denny's and Fred's fax machine to maintain. So, we could sure use an airline announcement or two to pave the way instead of more dilution paving the way for the near term. Whatever happens with DM and case filings, it is a very safe bet that the conclusion (that's the Show Me The Money part) will not happen fast.
Just thought I would throw my $0.02 into the good specualtion today...off to see The Wizard about breakin' up some of this road and sellin' it into this gold market.....
