I would tend to agree with you regarding Nunally doing all of the research and DM taking the case solely on his assurance.  Certainly they have their legal team of experts assembled to verify and construct their arguments.

However, if Nunally identified, for example, a Texas Instrument or Sandisk platform as having the MOS inside, then it would be a simple matter to then follow their customers and products utilizing those platforms.

Sure gets more interesting....
