There is nothing solid in the current law suits as a result of the CE ruling.

The thing is, the CE ruling, IMO, and the way it was ruled on for 774 and 108 favors e.Digital, that does not sound logical, but it is. Lets get the CO Markman ruling behind us with the results of this appeal and then see what happens.

The CO Markman ruling, IMVHO, was not directly appeal able by e.Digital, especially having 108 entered into an appeal at that level as a support issue.

Why is that so hard to understand?

For the recent 39 filings...they are about 108 ....and claims construction starts there....a new ball game.

Thing is, if the CE appeal is positive and happens prior to a claims construction ruling on 108...IMO, watch how fast the defendants settle, if the claims construction surrounds related considerations.

With that, watch how fast 737 comes back to life if the appeal is positive.
