If they call form joint dismissal and, as you state, "the case called for more than a single ruling which was not completed, therefore no final lawsuit completion", wouldn't the dismissal have to be without predjudice to preserve EDIG's rights to prosecute the "complete ruling" (as you describe it)? It seems that might take some fancy dancin'.
