That statement begs the question...

Nanully has identified 174+ entities that make products which infringe on EDIG patents. EDIG has told us if the product uses an SD card and you take it and it does not work it infinges on EDIG patents...

DM has been retained to enforce claims against any identified infringers for EDIG.

If APPLE qualifies as an infringers it SHALL BE SUED, and the fact DM may have a conflict of interest does not is not a hindrence to filing of such a law suit...

DM may disqalify itself from prosecuting the case, but they cannot simply ignore suing APPLE...
