"The defendants attempted to abreviate the discovery process by pushing the court to schedule the Markman Hearing prior to "full blown" discovery. The court ruled that full discovery will proceed 21 days after the 7/30 hearing."

"ORDER: Plaintiff’s request to be relieved from the stay with regard to further discovery is GRANTED, but the effect of the order is stayed for 21 days. If during the 21 day
period counsel enter into an agreement with regard to how they might take an
appeal from a construction determination
, the Court will reconsider this
determination that discovery go forward.

Jefother...To me it looks like the court is telling the defendants to play ball with the first phase of discover...she's giving them twenty one days, where upon she will reconsider the "full blown" going foward.

One way or another, it's good for the plaintiffs.
