Don't fret on the fact that in the excitment of 7/30 arrival we all missed a sneak ruling by Juge Kreiger when she set the date of 7/30 for her decision on when the Markman will be held. In order to cut the squable for a Mini Markaman before the discovery was started, (Defense Call), or a Full Markman after the discovery was completed (DM's call), the Judge issued an ORDER that she would decide all the issues, including admission of WOOD's testimony on 7/30. Snuck in there was an ORDER to STAY and discovery by the parties till after 7/30 ruling.
Obvously, now that she has ruled for DM's version of a Markman Hearing, there has to be some time for the discovery to be completed. That is why we ended up with 3 months time for that.
As for what happened on 7/30 DM had a WIN/WIN...
They got their discovery before the Markman Hearing; they also get to admit Woody's tetmoney if defendant decide not to play nice and take his deposition.
