Possible... and not much longer until we find out one way or the other.
I can’t help but wonder though if now it might be e.Digital that’s un-willing to settle for nothing at this point. Considering all that’s happened and the rulings thus far, I think I’d want my day in court just to try and recover some of my costs for this mess... something that digEcor would not likely offer as part of any settlement.
I don’t know... I’m just saying that if digEcor offered to let this case go for maybe $25,000 and some admission that we failed to deliver, I’m not so sure that e.Digital should take that just to make the case go away and still have to eat their own costs. Maybe it’s unlikely that e.Digital could prevail given appeals and such, but I think I’d take the attitude of "We didn’t start this but now we’re going to finish it". I know I like the idea of BOW trying to settle with us now and of us saying, "No... that time has past". I suppose it probably comes down to which side is more afraid of losing... and how much they figure is at stake.
Trial or settlement - either way it’s going to be very interesting to see what happens. Personally I’m hoping for trial if for no other reason than because that way we’ll get some good details. A settlement is more likely to be shrouded in secrecy with both sides claiming some sort of victory leaving us to speculate as to what really happened.
The share price is doing what it always does during periods of relative quiet and no clear or immediate signs of news - it drifts down on low volume. We’re lucky it has held up as well as it has for this long. We may be in for a long summer waiting for DM and Samsung to get more interesting as they approach Markman. I don’t think they’ll announce more infringers until that case is much further along or perhaps resolved somehow - although such an announcement could and would come right out of the blue without warning. I’m now hoping for a good digEcor outcome, a significant eVU order and/or partnership announcement, and excellent quarterly/annual numbers to be reported in June - in that order please. DM is officially on the back burner for at least the next 6 months... unless they surprise me.
