doni, I believe this will be a key issue with the Court in determining the enforceability (sp?) of the NDA.  Clearly Bill Boyer's written NDA contains the fraudulent language "Patent Pending" in paragraph 2.  EDIG was duped, before signing, that Boyer's idea was that of a unique device when this is NOT true.
