Way too much discussion of what ifs and not enough pertaining to WHY, imo. And understanding the WHY is probably more important at this juncture.

TPL owed Brown roughly 10 million for quite some time. DL has managed to keep litigation going so as to avoid payment. The last part of that Brown trial is now over. The judge issued a tentive decision which was about to become final. Brown even pressed for the judge to issue the final decision quickly since TPL threatened to file chapter 11.

Had further action not been stayed, TPL would have to come up with the 10million in cash. My understanding is that, if not paid in 30 days, Brown could seize all bank account balances belonging to TPL and all new money deposited, until paid. I'm sure I will be corrected if that is not accurate.

If the above was indeed a possilility, then in order to insure continuation of MMP litigation efforts, the chapter 11 filing was a necessity and beneficial to all MMP stakehkolders by preserving cash for income producing activities.

At least that is the way I see it. Other opinions on WHY are welcomed.
