"...and what happens if PDS requires a capital contribution from the partners and TPL can't contribute because the creditors object to the use of any cash collateral? How would that effect the relationship and licensing activities?"
The creditors don't make that decision, the Trustee does. Would the Trustee jeopardize the current litigation? You be the judge.
"..and what happens if creditors object to (TPL's) recent past investments to PDS? Will the court view those payments as a tacit payment to a creditor? Would/could that creditor be required to return the money?"
Can you tell us how much money TPL has put into PDS in "recent past". I didn't think so. And if the trustee insisted that some of the money come back? First, I doubt that would happen for the same reasons he would not hesitate to put in cash as per above. Why is he going to cut off his nose to spite his face. That's not what this is all about as you are trying to make it seem.
You are right, there are many things that could happen regarding the BK. And you keep trying to conjure up bad scenarios where PTSC will be hurt. And you keep failing. You also want to pretend that it's likely things will happen that don't make a lot of sense, like TPL selling their ownership in the MMP. Why would they do that? Why would the Trustee do that? The only possible explanation I could come up with is if the MMP was worthless and they were just trying to get what they could for it. And if that's the case (the MMP being worthless), we'd be dead in the water anyway, regardless of the BK.
Yes, Seaside, I have been involved in BK's. I do know a little bit about them. Certainly it seems more than you. And you know what, after 30 years of doing what I do, I have a little bit of a sense of judgement regarding financial and business matters. You are obviously lacking in those areas so maybe it's time to re-appear as someone else cuz this alias isn't getting you anywhere.
