Thanks insnoop. I guess my only remaining question has to do with the reversal rate in the ED of Texas. We saw a lot of stats, it seems, indicating a very large percentage of times (97%?) where the Markman resulted in a settlement before going to trial.
Perhaps what your references suggest is that those disputes that actually make it to trial and conclude in favor of the plaintiffs are later overturned on appeal, and the aspect that was overturned was the claims interpretation of the Markman. Sorry to make this so complex, but conflicting stats raise the eyebrows. But we also have to keep in mind how stats are used, frequently, to skew a perception one way or another....
I not trying to be argumentative, necessarily. Certainly you can understand why my eyebrows are up. Where's those stats on ED of T - Bueller, anyone?
