Yes, but if KRY waits the 90 days it's then too late to file with the ICSID!

Obviously any attempt to "correct" the supposed "breach" will eventually be deemed inadequate by Venezuela, and the failure to use the 90 days will be used as a defence that KRY did not exhaust all legal avenues before going to arbitration...

Just another example of the Venezuelan legal system at work!
