This issue has been addressed by Jim Brisco personally in a previous post on this site. Both Briscoe and the person (can't remember his name) in charge of the company that signed the letter of intent with LBSR (can't remember that company's name either atm) agreed that the grandfather clause should apply in this case. While I don't remember the names, I do remember this fairly clearly.
