They are executing settlements under the CE appeal for 774 and 108....and though 737 is not part of the CE, the defendants have composed claims construction on it that is similar to the 774 / 108 problem.

They are setteling from a weak position. Also keep in mind for specific devices and time frames of infringement...prior, current, and future.

They are contemplating that the appeal will not be completed prior to the end of fiscal 2014.

When / if 774 / 108 clear this hurdle things will be different.
