Looks to me MK screwed it up, not DM.
As Handal said, CO Court did not have the benefit of the USPTO's approval of revised claims and re-issued patents.
No legal knowledge here of course, but if we appeal and win the arguement, what next...lets settle???
At the SHM, they fully expected settlements before the Markman.
