If you review earlier files, you will see that RP gave POA to DM for the published patent on 4-16-2007 in order to make corrections, however, that affiliation was not formally recorded by the USPTO until the dates you point out.

The defendants new this, .....however, they preferred to send to the attorney of record regarding the application instead. With that they are playing games.

The USPTO has not assigned the re-exam yet....and it looks like that is not going to initially happen until after the current Markman issues have passed.
