No.....the court will understand.
However, the court must weigh issues that are not published or detailed in 774. During the prosecution process of the patent there are apparently comments / testimony on the record that the defendants want to have weighed by the court in having claims meanings changed to fit their defence.
They site their findings of precedent to get what they want in that regard....and e.Digital site theirs in keeping it out.
