I have no real concern for that...

My concern is for how the prosecution history, in particular the commentary and testimony of record, are allowed with regard to how amendments to the patent applications are weighed by the court. Some of which have nothing to do directly with the 774 published issues...boiling down to the meat of the Markman....who gets what entered or considered, published or unpublished.

As investors, we have had excess to the published patents in weighing our considerations, however, we were not privy to the prosecution history as recorded.
