Numero Uno....Any settlement will NOT be for "back compensation" only. DM will calculate some ratio of what forward use is worth and any settlement will take that into account.

Numero Dos....(a little Spanish lingo here)....If you were Edigital, in the financial position you were in, would you rather have (picking a figure out of the ether) $10,000,000 in the bank right now and be done with it, or $1,000,000 in the bank and royalty checks (maybe) for an indeterminent amount, (another figure out of the ether since I have no idea how this would be worked out) say $2,000,000 a year which could vary greatly but would require close monitoring and personell to do so. But above all would have an ENDING TIME in the near future. The patents for EDig's IP die in a very few years.

Personally I would take the cash in hand and be done with it. In my life, as I am sure in yours, cash in hand is always preferred to a "check is in the mail"....
