I believe the average for a trial schedule is 11 - 15 months in Marshall, TX (Rocket Docket) although the case I was involved with would have been about 20 months out for trial if we had not settled quickly.  In some Dictricts, it takes 3 years to start the process, so we are lucky to be in a more patent friendly environment with Judge Ward -- and we know he is a no BS kinda judge from PTSC's pending case.  Obviously, DM KNEW all of this as well.

So, the six month settlement window makes sense, but anything can happen.  Since I've been there and done that, I can state that it took us about two weeks to figure the mess out and make offers for a royalty agreement.  Who nows, maybe DM knew Vivitar would not likely fight it and will settle early -- a nice present for the ASM should it happen during the fall as expected.

I've looked through Vivitar's product mix.  They really do have a pile of products on the market and in some of the largest US retailers.  I have mixed feeling about asking one of the Big Box buyers about Vivitar, but I'll get on it with my next one-on-one meeting and the industry small talk portion.

Now, how about some eVU news in the next week or two?  Gotta guess Willy and gang are busy doing their thing these days.
