GAC - Everything except for 2 items (ix) and (x) are already known by the company so they are able to pass that info via a (CA) Confidentiality Agreement. Most of the info is in the protocols for the trial which are already in the public domain. The gross number of events is reported to the company regularly. The info is not broken down between dosed and placebo. The current enrolment has already been PR'd so the only thing that may not be deliverable is the current RRR. Although this requirement is stated in (x) it doesn't necessarily mean that it was delivered before the loan was funded. The company may know the events until interim analysts which could also be conveyed via CA.
I see nothing in here to get excited about.
When I buy a property or business I put all kinds of stuff in the offers just for negotiating points. Sometimes you get lucky and end up with a bunch of stuff you never expected just because it was in the agreement.
