This seems largely the strategy TPL is employing, and if so, WHY it's so important to get a LITIGATED VERDICT.

If, as has been posted here, the US District Court takes precedence, and overrules the ITC, then indeed, we should then be able to go back to all of those remaining ITC non-licensers and, provided their tech is similar to HTC's we should be able to expect to get a favorable appeal from the ITC. If that precedence is accurate, that would certainly add leverage to them to sign, as at that point, the ITC should be able to impose injuctions to stop the selling of their products.

With the retail season about to be in full force, I would think that would play into the dynamic in our favor.

Additionally, if this is an accurate scenario, the ITC may be the more likely venue for future legal battles as it has a quicker fuse legally (corrections welcome) and it holds the leverage hammer of injunctions that have the ability impact the infringing companies more immediately than a court process.
