My guess is TPL would have settled with all parties if they had the money. They didn't so they tried to delay as long as they could and then had no choice but to go trial. I think if the MMP starts bringing in significant licensing fees that TPL will quickly settle with all remaining parties. The question at this point is, will Moore want a settlement with TPL? I believe Leckrone has done whatever he could do legally and illegally to keep his doors open while the MMP has been hobbled by the PTO and the court system. The billion dollar question is what is keeping the license fees so low. Hopefully the Markman is the last remaining hurdle and if positive the infringers will finally line up up with checkbooks in hand. This case(Barco et al) has cost many millions on both sides and I am hoping that the bean counters now have a number to gauge what a settlement vs trial will be worth.
