It seems to me that his ruling (whenever it is made) although important enough, pales in comparison to the motion for summary judgement which is scheduled on the 27th. That motion if granted means there won't be a trial....correct? If so, and at that point, of what importance is the judge's opinion of the claims construction. It would seem to me that if the summary judgement is not granted then for sure the Judge's decision regarding the interpretation of the ten claims will be very important for either a settlement or trial.
Corrections anyone?
