Unfortunately we lost our appeal after that. Arm is safe with the J3 ruling, but not necessarily with any future infringers. I am not sure if they would, or would not, be safe in the future because I don' t know how their arguements in the Texas trial would affect our NEW ammendment of claim 29 during reexam? We need some EE's to look at that. They may or may not be safe going forward?
