With a recertified '148, why in the world would you think TPL should offer a license for a low-ball price? So they can negotiate us down from there?
As for the "dice rolling", if we had to take 'em to court, the only thing left to argue is whether or not they infringe. And I would think we wouldn't take 'em to court unless we're certain they do.
The proper strategy with a recertified '148 is to ask for the moon, and take something a bit less. We'd have 'em by the short hairs. And the possibilities for injunctions would be greatly enhanced (e.g., valid patent, vertified infringement because they use the same chip [design] as X-number other licensees).
IMO, rethink the license pricing strategy.
