The examiner's rationale for rejecting those new claims is not unfounded. There is a sound basis, which makes fighting it a bit more problematic. And if little or nothing is lost by foregoing those additional claims, why prolong the reexam? They did keep some of the new claims that they felt could be easily defended. IMHO
