I agree 100% with your post, but have one question, which might be a stupid one. I too have thought about this, but Pohl stated (at the 06 SHM I believe, could be wrong) that management met with their SEC Attorneys and it was decided that the dividend payout was the best route. If this is true, than I would venture to guess that even though it isn't fair to include warrant holders in the dividend payout, it isn't illegal either? Hope all is well with you!
