One possibility is that the Defendants are going to try and pull a "rabbit out of the hat", by trying to trick the Court into believing that Moore made all of the inventions by himself and all inventions singlehanded at the "Oki" facility and therefore it is either that facilities property or public property or some other ridiculous argument. Making the argument false before it starts (among numerous other reasons) is that they waited for 15 years or so to make the false claim.

This may be way off, but in light of the facts you and others have raised, it is the only thing we can think of right now. If this is so, we should see the $4 or $5 we have been hearing about very soon.

Remember, the Markman is an actual Trial within the Trial - and the majority of the Defendants in this case, have hired the best attorneys available, to tell them to settle.
