The only thing I can come up with on the Settlement Agreementh question is obvois in nature. There is an Agreement between the parties that was dated December 2, 2008, and this agreement sets conditions to be met before the amendment to the PDA would become effective. What is interesting here, that the December 2 Settlement Agreement came about just 3 days prior to the land dispute hearing that was set for Friday December 5.

6. Notwithstanding anything to the contrary in this Agreement, this Agreement will not become effective until and unless the conditions set forth in section 7 of that certain Settlement Agreement made among the parties to the PDA and dated December 2, 2008 are satisfied. The effective date of this Agreement shall be the date on which such conditions are satisfied (“Effective Date”).

This so called Settlement Agreement must be quite a lenghty one. Read section 7 in the Material document:

7. Section 18 and 21 (a), (c), (e), (h), (s), (t), (u), (v) of the PDA, the terms of this Agreement shall prevail.

I sure like to see this Settlement Agreement.

As for the Falcon Lands, the answer is easy. No, they are not part of the eamended PDA. Look for the bracketed words ( excluding the Falcon Lands) Also look for the heavy black outline on the Map that marks the borders for the lands that are included in the amended PDA.

Whereas ExxonMobil Mako, TXM, Falcon and MOL are parties to the Production and Development Agreement dated 10 April 2008, as amended from time to time, (the 'PDA') and the joint venture parties in relation to certain parts of the Mako Trough-I. hydrocarbone Mining Plot ('TXM Mining Plot') ( the 'TXM/Falcon/EM/MOL joint venture'). The current boundery of the TXM Mining Plot (excluding the Falcon Lands) outlines the 'TXM License Area' - see Attachment 1. For avoidance of doubt, TXM's exploration licenses, even if they relate to the Mako-Basin, are not subject of this agreement.
