1. For the avoidance of doubt, TXM's exploration licences, even if they relate to the Mako-Basin, are not subject to this Agreement

Section 6 on page 5

6. Notwithstanding anything to the contrary in this Agreement, this Abreement will not become effective until and unless the conditions set forth in section 7 of that certain Settlement Agreement made among the parties to the PDA and dated December 2, 2008 are satisfied. The effective date of this Agreement shall be the date on which such conditions are satisfied (“Effective Date”).

Begs the question: What settlement Agreement?
