I doubt that the company will not close the PP financing. But, if they don't, my speculation is that all assets get auctioned off as soon as possible, including the arbitration award rights. The auction will determine what the assets are worth and the proceeds are divided according to the hierarchical structure in order of creditors, bondholders, preferred stockholders, and finally common stockholders. High bidder of the arbitration award asset then waits for their reward.
This is why the company is desperately trying to close this PP.
