jimmi, every prior case i've looked at from icsid...both ven and others... always look at the damages based upon the time of filing or "should have been filed date"...i.e. POG, expenses at the time, exchange rates, etc....

i.e. future earnings would be based upon a price at an initial filing (lets say $900oz) and carried forward at that amount....

imo based upon prior icsid cases and precidents..
