Maybe some people missed my point. There are tremendous reverse implied odds here. Let's just say the DOI goes our way, but some enviro person or group sues us anyway. My point is, how do we finance the litigation? Another billion shares of stk might not be enough, and the case could take years. On the other hand, if the co doesn't properly defend itself, and loses the case, all further work at SB might be permanently enjoined. Lots of time, effort and money gone... and HM still sits dormant. Maybe I'm missing something, but I sure hope JB and directors are carefully thinking this through.
