Law360, New York (June 12, 2017, 9:37 AM EDT) -- The U.S. Supreme Court agreed Monday to decide whether America Invents Act reviews violate the U.S. Constitution, throwing the future of the popular system for challenging patents into doubt.
The justices granted a November petition for a writ of certiorari by Oil States Energy Services LLC, which argues that only federal courts, not executive branch tribunals like the Patent Trial and Appeal Board, can decide whether a patent is invalid.
