We have the cart before the horse and the USPTO needs to get its ducks in a row first prior to any civil suits.

This is where I have a problem.

An IPR owner cannot file for an IPR on it's own. It can only be filed by a defendant in a civil action, where claims construction matters carry on prior to any IPR matters.

As I see things, there is no logic in that arrangement.
