Iam...as I see things...

IPR validity now trump claims construction...lol

We need an IPR to put it all to rest.

A Defendant recently proposed a 417 page dispute for an IPR.
IMO, its not really going to matter what a judge feels of claims construction matters.

We have the cart before the horse and the USPTO needs to get its ducks in a row first prior to any civil suits.
