The court can lean on the IPR results, as the defendant points out.
I feel the opposite is a consideration, the USPTO/IPR can/will lean on the courts Markman hearing...
And that thought is in regard to theexistingMarkman order already on the record. The USPTO will, IMO, lean on that existing order it if there is ever an IPR....by future defendants.
