I say yes, and have previously.....108 was not litigated in the Apple case, patents 774 and 737 were the only issues.

Thing is, IMO, before e.Digital might swing 108 in Apples path it would want 774 appeal resolved and 108 shaken from the appeal.

Same deal for others as well.

774 becomes the foundation of settlements that the other patents will lean on. There is just no telling how the SPJ's worked for e.Digital in preserving its future rights. If we had these details we might have a better idea.

IMO, Apple is working the time game and hoping that time will run out, the devices e.Digital named were limited and Apple tested the bounds. Where the SC judge did give e.Digital a little token win on SSD plug assembly in the Apple product.

They're all waiting for the gate to open for free future use.
