There is a bit of a gamble here, if they are negotiating...108 being cut free of the CE appeal process. The CE issue is about 774 issues and 108 was not part of the 774 CO ruling questioned by defendants or detailed by the judge.

It's up to the appeals court to decide the fate of 108 and should it have to endure the 774 CE mess.

Could the judges set 108 free early as a separate condition of the appeal?

No telling what can happen in this circumstance....

As separate entities go, I see this as a mistaken identify issue, or victim of circumstance.
