Our trial court judge Sabraw is a seasoned judge. I think he'll find for the motions to stay, but find against any screw-ball motions to amend the joint stipulation. I think Kohm is way out of line and the judge won't like this tactic. I think we'll go up to the 9th Circuit without the other hangers-on. But when we get there, I'm not sure we can overcome the trial court's finding. Remember my football analogy--the ruling on the field stands unless there's unequivical evidence to the contrary. Thank goodness we've got the most liberal Federal Circuit Court in the USA, but Apple is a national treasure and this could end up being a very importnat case.
