So DM dropped the ball in regards to the correct prior art regarding the encryption patent and produced it too late for consideration and then publicly showed up the judge in the Markman hearnings when they referred to a mistake that the judge had made in a past case that they were involved in and potentially cost us a year plus delay. I was wrong. I was one who thought it was a good thing that after significant due diligence and investigation, that the big law firm, DM, would take our case on a contingency basis. Handal, with the help of Blue Sands and IPMetrics have done an excellent job for us so far. Their strategy to sue the retailers and then dismiss the suits in return for sales figures for the infringing products seems to be working. The per unit value of any settlement still has to be negotiated, but Handal removed a huge moving part in securing the sales totals which the defendants cannot refute. Handal is doing an excellent job--I guess size doesn't matter after all.
