I am seeking yet another clarification today of the Aug 30 appeal filing to hopefully put this to bed for good.

I had a phone conversation with Fred when I saw the filing, asking what we were appealing, since there was no rejection sent out. Not knowing my way around the USPTO paper flow very well, it confused me.

Fred said, "despite not getting a response either way, there was a deadline to file for an appeal, in the event we received a rejection."

In other words folks, this was a procedural move as I understand it.

If I get a reply, I will post it.
