The explanations given of preamble language within the original claim 5....where argued and considered not having to change claim 5 at all.

The examiner would not consider the preamble language....with that, the next step was to amend.....which they did.

If the appeal is still in play, things have panned out as I considered. E.digital got a commitment on the amend as they would like it and then appealed, IMO based on the preamble language consideration.
