An echo of my words for the last 6 months.

Number 1 would be great and only time will tell us about how unique the concept is.

Number 2 is more likely since they developed the concept and the market may not even need the features. I have said all along that you go to the market and ask or access what their needs are and you design accordingly. They tend to design and hope the market wants what they have, an unsuccessful approach most of the time.

I'm counting on the patents to generate future profits, if we get a favorable USPO ruling.
