Nunchi may or not mean anything.....we have heard the same thing about a lot of things like this over the years so I am not getting wound up about it, but if believed, and if those statements by FF, AC and FF have any truth to them (I mean the testing, patents, contacts, prospective users,,,etc...) and can be verified then there might be something there.

The Judges opinion in Colorado was a "RULING" not an opinion......It's dead.....

Also dead is 737......I was surprised, when I asked AC about what was happening with 737, that he said "The judge is doing NOTHING on 737" I asked when she would be, he replied quite forefully "THE JUDGE IS DOING NOTHING ON 737'' I pressed him a little further and he replied, I think giving more info then he wanted, "It is to our advantage to NOT have a ruling on 737" It will take a legal mind much better than mine to figure that out but quite obviously we won't be getting a ruling on that patent now or in the future from this judge.

FF's highlights were his and PN explanation and demonstration of the NUNchi.....My take is it is a system, when you sign on, that in effect reads your mind......no shit......it memorizes into a complex system, everything you do, say, like, dislike......everything....without you doing a damn thing.......But has ample privacy if you "tune out"

FF's other highlight was his mentioning at least 3 times about the "patent re-exam" and how vital it was to the company.

THIS IS WHAT I AM HANGING MY HAT ON.......FF mentioned that he, Woody Norris, all the engineers would be there IN PERSON when the re-exam takes place to clarify the "plain meaning" of the words the inventor intended to convey. This is a huge advantage to EDig because FF, etal, will be able to direct the examiner with "give and take" not thru emails or letters.

Since Doni, Sman and others have dug up volumes of information on both patents, their connectability, the obvious misreading of "digital and analog" uses in those patents I regained a few shreds of "hope" for the future of EDig...

This area is to me the most vital going forward because, as of now, it is the one area where "hype" does not come into play. There are facts here, that can be checked. EDig gets a favorable "clarification of the meaning of what the patents says" or it doesn't. If it does "It's off to the races, and "OUTTA TOWN", or Colorado to be more precise and to round 3 in another courtroom, in another state without any baggage of the Colorado hearing to contend with. The way I understand it, at that point, her ruling will be meaningless to the infringers in rount 3. Of course if the ruling does not "clarify the meaning" in EDig's favor then Nunchi will be the only hope EDig has.

I stress, FF, Woody Norris, and the EDig engineers will be at the patent examiners office when he starts his ......EXAMINING....FF talked to me privately and re-iterated just how 'HUGE" this was to EDig's case. I am unsure the date this request was made and I believe it was made by a company in round 2 we have already settled with so that might be an added bonus to EDig's chances, the entity who requested the re-exam won't be there. This exam generally takes a year or longer, but could take less. We have all been around a lot longer than a year so another shouldn't be a hardship especially if we are waiting for something "CONCRETE" factual....something we can verify.....I have that time so I will ignore everything else and wait. I think the chance is a good one it will be favorable to EDig.....of course I couldn't see how we could lose the Markman hearing either so what do I know.

EDig is still "settling" with some infringers in round 2 so look for a few more to pop up now and then, they are still "negotiating" with a few of them. Mostly nuisance settlement but still funds to keep the doors open. As FF said if the Markman had gone in our favor those settlements would be huge..

EDig is in good financial shape, able to pay the patent examination attorneys and above all keep the doors open and the lights on.

The following will be meaningless to Ron and LL but I did drop by EDig's palacial headquarters last week when I knew FF was on vacation. I wanted to get some insight from someone else if I could. I knocked on the locked door and it was opened by "Marty" the young lady, I think secretary, at the front desk. After pleasantries were exchanged I asked Marty if she was busy?.....Yes, very.....On upcoming projects or just mundane junk?......future stuff.....How did she feel about working there?.....Great, How do you see your job progressing?......Great........Was she excited about her job in the future? What expectations had she for the future? ......Her reply was a very positive...."This coming year will be great for the company"

OK, OK that was for my consumption only....you make of it what you will.....But she definitely did not sound as if she was "temp" or acted that way...good attitude...
