Agreed. My layman's guess is there is A LOT of legal wrangling/negotiating going on between the legal teams. Will be very interesting to read the joint statement due by 28 July.

I am hoping that whenever this case is finally over, DM will appeal and the appellate court will once again overturn Judge Krieger for putting too much weight on the patent prosecution history and not enough weight on what's written in the 4 corners of the patent/specifications. That's what Jameson reminded her in court...that the Phillips case, which she was overturned on, taught everyone to put more emphasis on the patent language for claim construction, rather than other intrinsic evidence. I think she fell short once again here.

If she were to get overturned again...ouch.
