Hello all,
Okay, I have calmed down a bit, sort-of. It has taken me some time to get over the "Undecision", but in fact I now realize that it was a Ruling in the defendants favor with a 30 day caveat for arguments to be submitted (7/28?) to decide what the parties will do.
However, I must admit the whole thing continues to baffle me. Like, how could have JK gotten it so wrong? To me, it all comes down to Woody's inconclusive testimony. He simply should have said, "Of course Flashback ('774) had RAM within it as a tempory processing volitile memory requiring a power source that was required by the CPU, DSP, & CODEC, and RFM was the main resultant "storage" memory of processed data. The Flashback device couldn't function without RAM. RAM is found in nearly all electronic devices, but I will tell you this, Flashback ("774) was the 1st handheld portable recording device to use RFM as its main non-volitile storage memory.
I seem to remember that there was some discussion about prior art, Hard Disks, Diskettes, etc., during "774's rexam but not RFM. I'm not sure this is pertinent or not, but I do know no handheld portable device before Flashback had RFM. But now that is neither here or there. Unless...
What happens now? Can we absolutely appeal and go to trial, which will take what, another year? Will DM hang in there? I simply don't know. I reckon we'll see.
Finally, I want to thank in particular sman998, doni, and some others for for their research, and all of you for hanging in there. And I hope you, Joe, are continuing to forward the important posts to FF & PN, and hopefully they get in the hands of DM.
