The relevance of the greater discovery regarding design and manufacturing goes to the heart of intent and the ability to decide on treble damages if warranted IMO. These items are significant and should not be dismissed so easily. However, that said, the costs born by these potential infringers will likely be significant regardless but for me the issue is about being able to fully and fairly litigate our case against the vermin.
